ONLINE ORDERING AND SALES CONTRACT

Customers can order products from LoveWithoutTears.com online, by email or by phone. The order is only considered valid after the LoveWithoutTears.com team confirms to the Customer by email/phone the possibility of fulfilling it.

ORDER CANCELLATION BY THE CLIENT

The client can cancel the order by email only on the same day it was placed until 4:00 pm or on the official Facebook page "Love Without Tears", under the same conditions. The order can no longer be canceled after the customer has received the delivery confirmation email.

ONE ORDER ONLY

Orders placed on the same day to the same destination by the same person, or from the same IP address, are automatically combined into a single order for which a single invoice/receipt is issued. Discount coupons or value vouchers are applied only once to the combined order.

CONTRACT BETWEEN THE PARTIES

According to the legal provisions in force, the order finalized and confirmed by LoveWithoutTears.com is considered a contract concluded between the client IUBIRE FARA LACRIMI DIGITAL SRL, which must be executed by both parties.

According to art. 1,657 and art. 1,660 of the Civil Code, the object of the contract is the good/product sold, in exchange for which the client will pay the price set on the site, which is a serious and determined one.

The costs regarding the delivery or/and other costs of the services are mentioned when finalizing the order request and will also be specified when confirming the order by LoveWithoutTears.com.

Thus, the CONTRACT enters into force upon order confirmation by the company. LoveWithoutTears.com never considers an unconfirmed order as having the value and legal regime of a contract.

These Terms and Conditions are contract clauses between the parties. The following mentions are added regarding:

UNILATERAL TERMINATION OF THE CONTRACT

The client can unilaterally terminate the order if LoveWithoutTears.com delays the delivery of the ordered products, except in cases of force majeure, for a maximum of 7 business days after the deadline specified in the order confirmation.

The unilateral termination must be made in writing and sent with confirmation of receipt by confirmed email, before the moment of taking possession of the ordered product/services.

In this case, if the payment has already been made by the client, he/she will be refunded the money, within 14 days from the moment of receiving the product/services not accepted by the client, according to the payment option specified in the order form.

ORDER CANCELLATION BY LoveWithoutTears.com

Some orders require the client's agreement on delivery conditions, payment, etc. The holders of these orders will be contacted by LoveWithoutTears.com by phone or email. If within 10 days the client has not sent any response, LoveWithoutTears.com assumes the right to cancel the order.

If LoveWithoutTears.com is unable to deliver the order due to the client's fault (either they cannot be found at the stated address or cannot be contacted), the order will be canceled and the products will be returned to LoveWithoutTears.com. For a new delivery, the client will have to bear new delivery costs or other technical costs that arise.

If the client has paid in advance and, due to their fault, cannot receive the products within 10 days from shipment and cannot be contacted within 30 days, the order will be canceled, but the payment cannot be refunded, constituting compensation from the client.

PAYMENT AND PAYMENT METHODS

Payment will be made based on the Tax Invoice issued by LoveWithoutTears.com in accordance with art. 319 of the Fiscal Code, which will be sent to the client together with the ordered products at the delivery address.

The invoice will also include the VAT amount and will be issued exclusively in RON.

The company discharges the risks and responsibilities associated with the products and services ordered by clients at the time of handing them over to the Client/their representative.

The ownership of the products and services will be transferred to the Client at the time of payment.

Payment for the ordered product/services can only be made in the following situations:

• online by card, in complete safety conditions, when placing the order. Cards accepted for payment are those issued under the VISA (Classic and Electron) and MASTERCARD (including Maestro) logos.

• online with PayPal

• cash on delivery

DELIVERY METHODS

• delivery by courier - 2-3 business days

• electronic delivery for digital format books

ORDERS WITH INTERNATIONAL DELIVERY

Orders with delivery outside the country are also accepted within the DHL area displayed on the site. The displayed cost is calculated for packages under 2kg. If the package weight exceeds this value, the delivery cost will be recalculated. International deliveries are made exclusively through the DHL courier service.

RETURNING PRODUCTS

Our goal is for you to be fully satisfied when purchasing products from LoveWithoutTears.com.

LoveWithoutTears.com will comply with the provisions of Emergency Ordinance no. 34/4.06.2014 on consumer rights in distance contracts, which gives the buyer (only under the conditions of the mentioned normative act) the right that within 14 business days from receiving all purchased products, without penalties and without invoking any reason, to return the purchased products, furthermore, extending the return period to 60 days.

In addition, returning products is only profitable if the customer has chosen to purchase two or more books. In this case, the cost of courier delivery to return the products will be borne by the client. Once we receive the products back, the money they paid for the products will be refunded to them minus the initial shipping cost, by card, PayPal or bank transfer depending on the return method displayed on the return form when sending the return request.

If the client purchased a single book and requests its return, the client is obliged to bear the subsequent costs of returning the book copy.

DAMAGES

LoveWithoutTears.com has the right when it considers that the client's actions were made in bad faith to request compensation from them, under the conditions of the legislation in force, before the competent courts in Bucharest.

LoveWithoutTears.com also reserves the right to later refuse to honor other client orders.

REFUNDING THE PRICE AS A RESULT OF RETURNING PRODUCTS

If the client chose to pay by card when placing the order, they will receive the money representing the price paid back on the card, by bank transfer.

If the client chose cash on delivery, they will receive the sum of money by bank transfer to the bank account specified in the return form at LoveWithoutTears.com/return

The client will only be refunded the amount of money they paid for the product(s). The delivery cost will not be refunded.

THE DIGITAL FORMAT BOOK CANNOT BE RETURNED

The digital format book (audio or ebook) cannot be returned under any circumstances and does not fall under the return period as it is a digital product.

Also, the cost of the digital format book (audio or ebook) cannot be refunded.

At the same time, the Client has the responsibility to check the compatibility of the electronic formats available on LoveWithoutTears.com with the device they own.

Secured electronic format books cannot be converted into other formats.

LoveWithoutTears.com cannot return, convert or make available to the client formats other than those existing on the site at the time of the transaction.

COPYRIGHT

The content of the www.LoveWithoutTears.com website (including, but not limited to images, texts, web graphic elements, scripts, graphic elements, logo and other data) is the property of LoveWithoutTears.com and its partners and providers, being protected by Copyright Law and intellectual and industrial property laws. For these reasons, the use of these elements without the written consent of LoveWithoutTears.com is absolutely prohibited.

USER ONLINE ACCESS

LoveWithoutTears.com does not guarantee users access to the www.LoveWithoutTears.com website at any time, not being responsible for problems caused by third parties (technical problems, failures due to the server or internet connection) or problems generated by upgrades or any other commercial reasons of LoveWithoutTears.com.

LIMITS OF LIABILITY

LoveWithoutTears.com makes continuous efforts to maintain the accuracy of the information on this site. Rarely they may contain small inadvertencies: the photo is for informational purposes, some specifications may be changed by the manufacturer without notice or may contain operating errors. We are always at your disposal for any clarifications.

All images and texts on www.LoveWithoutTears.com are exemplary. In this sense, the products delivered in the order may be different from those presented online (cover, packaging, color, appearance, accessories, format, etc.).

Also, LoveWithoutTears.com may change any time the details available online regarding the products and services offered. Product images and descriptions may contain errors or differ from reality, LoveWithoutTears.com is not responsible for such situations, but will try to resolve them as soon as they are reported.

ADDITIONAL INFORMATION

Prices on www.LoveWithoutTears.com include VAT, but do not include shipping costs or other expenses, unless otherwise stated specifically on the website.

Orders registered on www.LoveWithoutTears.com on Fridays after 6 pm as well as Saturdays or Sundays will be shipped on Monday.

LoveWithoutTears.com is not responsible for the content, quality or nature of book descriptions and comments posted by site visitors. Also, LoveWithoutTears.com is not responsible for the content of sites that are accessed via links.

AGREEMENT ON SENDING EMAIL MESSAGES

By performing the following activities: ordering, subscribing to the newsletter, sending a message on the contact page or sending emails addressed to LoveWithoutTears.com, the user is considered to agree to receive periodic emails containing various information strictly related to LoveWithoutTears.com.

In this situation, personal data will not be used for other purposes and, according to this contract, may be modified or deleted from the LoveWithoutTears.com database at the written request of the client.

FORCE MAJEURE AND APPLICABLE LAW

Both the client and LoveWithoutTears.com will not be responsible for failure to perform contractual obligations if such failure is due to a force majeure event.

This contract is subject to Romanian law.

LoveWithoutTears.com has the right to prohibit access to certain clients and visitors, for a limited or unlimited period, without prior notice.

DISCOUNTS AND PROMOTIONS

The price/discount policy on the site is set entirely by LoveWithoutTears.com, and the purchase price is the one displayed when launching the order.

Product prices are those displayed for each product and are updated daily. In principle, discounts, reductions and promotions are not cumulative. To calculate the amount, the reduction with the highest value is kept.

All promotions present on the site are valid while supplies last.
